【ARCFE News】 USCIS PUBLISHED FORM I-956K FOR AGENT REGISTRATION

On January 4th, USCIS published form I-956K (“Registration for Direct and Third-Party Promoters”). Under the EB-5 Reform and Integrity Act of 2022 (EB-5 RIA 2022), all direct and third-party promoters are required to register with USCIS. Each person acting as a direct or third-promoter (including migration agents) of the following must file form I-956K:

  1. Regional Center,

  2. New Commercial Enterprise (NCE),

  3. Affiliate Job Creating Entity (JCE), or

  4. An issuer of securities intended to be offered to immigrant investors in connection with a particular capital investment project

There is no filing fee for submitting the form I-956K.
