EB-5 PROCESS

Filing from Outside of the U.S.

Step 1

Choose an EB-5 project & retain an EB-5 attorney.

Step 2

Prepare documents for filing & sign investment contracts.

Step 3

Make investment & pay required fees.

Step 4

Attorney to file I-526E petition.

Step 5

USCIS approves I-526E petition; Investor schedules visa appointment at the U.S. consulate.

Step 6

Investor enter the U.S. with the visa issued & receive Conditional Green Card.

Step 7

90 days before the Conditional Green Card expires, attorney to file I-829 petition to remove conditions.

Step 8

Conditional Green Card expires.

Step 9

USCIS approves I-829 & issues Permanent Green Card.

Filing from Inside of the U.S.

Step 1

Choose an EB-5 project & retain an EB-5 attorney.

Step 2

Prepare documents for filing & sign investment contracts.

Step 3

Make investment & pay required fees.

Step 4

Attorney to file I-526E petition along with the Adjustment of Status package, which includes form I-485, I-765 and I-131.

Step 5

USCIS approves I-765 & I-131, issues EAD card & Advance Parole (or Combo Card).

Step 6

USCIS approves I-526E.

Step 7

USCIS approves I-485 for Adjustment of Status & issues Conditional Green Card.

Step 8

90 days before the Conditional Green Card expires, attorney to file I-829 petition to remove conditions.

Step 9

Conditional Green Card expires.

Step 10

USCIS approves I-829 & issues Permanent Green Card.
