The U.S. Department of State has published the August 2026 Visa Bulletin. The Employment-Based Fifth Preference (EB-5) visa categories are as follows:
Chart A: Final Action Dates
Mainland China – The EB-5 Unreserved category remains unchanged, with a priority date of December 1, 2016.
India – The EB-5 Unreserved category remains UNAVAILABLE.
All EB-5 set-aside categories remain CURRENT.
Chart B: Dates for Filing
Mainland China – The EB-5 Unreserved category remains unchanged, with a priority date of March 1, 2017.
India – The EB-5 Unreserved category remains unchanged, with a priority date of May 1, 2024.
All EB-5 set-aside categories remain CURRENT.

Important Note for Indian Investors
The August 2026 Visa Bulletin continues to list India’s EB-5 Unreserved category as Unavailable under Chart A. The Department of State previously confirmed that India’s pro-rated EB-5 Unreserved limit had been reached and that the category would remain unavailable for the remainder of Fiscal Year 2026.
For Indian investors evaluating the EB-5 program, the distinction between the Unreserved category and the reserved visa categories remains especially important. The High Unemployment Area, Rural, and Infrastructure categories continue to be Current under both Chart A and Chart B.
Investors pursuing adjustment of status in the United States should also check the USCIS Visa Bulletin filing chart guidance before filing, because USCIS separately determines whether applicants may use Chart A or Chart B for adjustment-of-status applications each month.
