The Department of States has posted the August Visa Bulletin. The Employment Base Fifth visa categories are as below:
CHART A: FINAL ACTION DATES
CHART B: EB-5 DATES FOR FILING
Except for the Unreserved EB-5 category for China, the rest shows “CURRENT”. This is the golden window for investors from countries that are prone to backlog like Vietnam and India to prepare to file their I-526 petitions. Per the Judge’s rule in the recent case agains USCIS, Regional Center’s investors can now file their I-526 without the need to wait until I-956 Regional Center redesignation to be approved.
According to USCIS, there is a new form for Regional Center’s investors called I-526E. However, the form is not available at this time. We are monitoring USCIS’ website for any updates.
